These terms and conditions govern the relation between all the persons using www.progressforafrica.org (the “Website”) or named on the booking form (“You” or the “Client”) and Progressforafrica.org (the “NGO”) when browsing or, in any manner, using the Website and/or when making any reservation with the Company, and are hereinafter referred to as the “Terms and Conditions”.

USE OF THE WEBSITE

By using this Website, owned and operated by the NGO, You agree to be bound by these Terms and Conditions.

As a condition of your use of the Website, You warrant that (i) all information supplied by You on this website is true, accurate, current and complete and (ii) if You have an account in the Website, you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than You.

Your use of the Website is intended for personal, noncommercial use and/or to make legitimate requests to book the products offered. You agree not to use the Website to make any speculative, false or fraudulent requests.

You further represent and warrant that You (a) have not previously been suspended by the NGO or otherwise banned from using the Website; (b) are not a direct competitor of the NGO; (c) You will not have more than one account in the Website at any given time; and (d) that You have full power and authority to enter into this Terms and Conditions and in doing so will not violate any other agreement to which You are a party.

We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of this Terms and Conditions.

YOUR PRIVACY

The purposes for which we collect your personal information when You register or email us are: administering the Website, sending you a password, contacting you about your booking and keeping in touch with you.

We may disclose information about You to our employees, agents or associates.

If You breach these Terms and Conditions or the law, we may provide the competent authorities with your details.

We herein commit not to sell your contact details to marketing companies for spamming!

BOOKING INFORMATION & CONDITIONS

All payments are to be made at the moment of the reservation by direct deposit into the Company’s bank account. Upon confirmation of funds being received, You will be issued with a receipt.

Cancellation and Refunds

  • If You cancel your trip:

Cancellations by serving, at least, 35 days prior written notice by the person whose name and signature appears on the booking form shall be accepted.

As we may incur considerable costs if You cancel, 25% of the price of the package You booked shall be retained upon cancellation.

No cancellations shall be accepted within the 35 days prior to the departure date of your trip.

  • If we cancel your trip:

If we are forced to cancel your trip for reasons beyond our reasonable control (force majeure) we will offer You the choice of a full refund of any monies paid or an alternative trip. The NGO will accept no liability for any costs incurred by You for anything other than the monies paid to us for the trip.

Accomodations

The best available accommodation is chosen at the time of booking that suits the purpose of the itinerary.

In the event of a particular accommodation being unavailable upon booking, accommodation of a similar or higher standard will be substituted.

Late Sign Up

In the event that You make a booking with Progress after arriving in Tanzania, we will endeavour to carry out your requests but You should understand the difficulties of late bookings in regards to obtaining accommodation, transport and without reasonable notice.

INSURANCE

Travel and Medical Insurance is compulsory for all participants. Your policy must include coverage for medical expenses arising from illness or accident before or during the trip, evacuation and repatriation in case of emergency, death, any loss or theft of baggage, money or personal effects. You should ensure that there are no exclusion clauses limiting protection for activities You undertake including, amongst others, altitude trekking (for Kilimanjaro and Mount Meru) and mountaineering activities.

You are responsible for their own insurance and the Company is not legally liable or responsible in the event a guest fails to take out adequate insurance coverage. All sporting activities undertaken by You are of their own choice and at their own risk. We advise You to review their insurance policies carefully as many policies will not cover injuries sustained in a high-risk activity. Travel insurance is also one of the most important aspect of protecting your trip in case of failure or cancellation, so please make sure that You have it in place from the moment that You first make your booking and covering the whole period before, during and after travel.

LIABILITIES

By accepting these Terms and Conditions You confirm and record that You understand the risk inherent in adventure travel in African destinations and associated activities.

You hereby accept and undertake to do the tour, travel or activity at your own risk.

You agree and concede that neither the NGO nor any person or agent acting for, through or on behalf of the NGO shall be liable for any claims, losses or damages to your possessions, or any injuries, illness or death which might occur You from any cause whatsoever.

The NGO does not accept liability for the acts or omissions of tour operators, hotels, carriers, or other outside the NGO over which it has no control.

JURISDICTION AND APPLICABLE LAW

The Terms and Conditions and all matters relating thereto are governed by, and shall be construed in accordance with, the laws of Tanzania.

Each Party hereby submits to the competent courts of Tanzania in respect of all matters arising out of or in connection with this terms and conditions.

DISCLAIMER

Although the NGO endeavors to provide accurate, up to date and truthful information on this site, neither the NGO nor any of its employees, agents and associates make any representations or give any warranties, whether expressly, tacitly or implied, as to the operation of the site, the information, content, materials and products included and available from the Website.
